Eligibility
CHALC Social Limited is open only to users aged 13 years or older.
Users aged 13–17 may use the App only after their parent or legal guardian provides verifiable consent via in-app verification email.
For UK users, this verifiable parental consent process serves as our age-assurance measure under the Online Safety Act 2023.
Users under 13 are not permitted to register or use the App (in line with COPPA in the US).
By creating an account, you confirm that you meet these requirements or that a parent or legal guardian has consented and supervises your use.
Account Security
You are responsible for maintaining the confidentiality of your login credentials.
Notify CHALC Social Limited immediately of any unauthorized use via [email protected].
CHALC Social Limited will not be liable for loss or damage resulting from your failure to secure your account.
Acceptable Use & Community Guidelines
All users must follow the CHALC Child Safety & Community Guidelines (https://chalc.world/guidelines).
We enforce these rules consistently and transparently in line with the UK Online Safety Act 2023 and applicable US laws (including COPPA and state age-appropriate design requirements).
Prohibited: harassment, hate speech, sexual exploitation, discrimination, violence, dangerous challenges, or any harmful or misleading activity.
This includes all illegal content and content harmful to children as defined under the Online Safety Act 2023 (UK) and applicable US laws (such as promotion of suicide, self-harm, eating disorders, or pornography).
CHALC may suspend, remove, or restrict content or accounts that breach these standards.
Challenges & Participation
By joining or creating challenges, you agree to follow the rules and act safely.
You participate at your own risk. CHALC does not endorse dangerous behavior and prohibits content promoting harm.
Challenge outcomes are final as determined by community admins.
Content Ownership & License
You retain ownership of all content you upload.
By uploading, you grant CHALC a limited, non-exclusive, worldwide, royalty-free license to host, display, and distribute your content for App functionality, moderation, and safety purposes.
Marketing use requires your explicit opt-in (and parent/guardian consent if under 18).
5.1 Community Content License
a. Ownership
You retain full ownership and copyright in all content you upload (“Community Content”).
b. Automatic License (App Use)
By uploading to a Community, you grant the Community Owner a non-exclusive, royalty-free, worldwide license to display, reproduce, and use your content within the CHALC App (e.g., feeds, highlights, leaderboards). This license ends if you remove the content or leave the Community.
c. Optional Marketing License (External Use) — Set at Join Time
When joining a Community, you will see a clear consent screen:

[Community Name] may use your uploaded videos and images outside the App (e.g., Instagram, website, ads) to promote the Community.
You keep full ownership
You can revoke anytime in Settings
No sale or sublicensing allowed
[ ] Yes, allow external marketing use
[ ] No, app-only use
If you check “Yes”: You grant the Community Owner a revocable, non-exclusive, royalty-free license to use your future uploads for external marketing.
If you check “No”: Only app use is allowed.
Users under 18: Guardian consent is required via email verification before marketing use is enabled.
d. Revoking Marketing Consent
Go to Settings > My Communities > [Community Name] > Marketing Permissions → Toggle OFF.
- You will receive confirmation.
e. Prohibited Uses (Even With Consent)
Community Owners may not:
• Sell, rent, or sublicense your content
• Use it in paid advertising without separate written agreement
• Alter content in a defamatory way
f. Transparency Dashboard
In Settings > My Content > Marketing Use, you can:
• See if permission is granted
• View sample posts (if shared)
• Revoke instantly
g. Corporate Communities
Corporate Community Owners (e.g., brands, sponsors) are bound by the same rules.
All external use requires your active, revocable consent given at join time.
Moderation & Enforcement
CHALC may restrict, suspend, or permanently ban accounts for violations.
We review reports promptly and take consistent enforcement action as required by the UK Online Safety Act 2023 and applicable US child safety and consumer laws.
Reports are reviewed by trained moderators.
Actions include warnings, temporary suspension, permanent bans, or soft deletion.
Banned users receive in-app/email notification with reasons and appeal instructions.
Appeals: [email protected] — reviewed within 7 business days.
Intellectual Property & DMCA Takedowns
Users may not post content that infringes copyrights, trademarks, or other IP rights.
CHALC complies with the DMCA, POPIA, and other applicable laws.
To report infringement, email [email protected] with:
• Description of the copyrighted work
• URL/location in the App
• Your contact info and good-faith statement
We will respond promptly and may remove content or disable accounts.
Termination of Account
CHALC may terminate or suspend your account at any time, with or without notice, for violations, safety concerns, or legal requirements.
Upon termination, your access ceases immediately.
Privacy
We collect and process personal data in accordance with our Privacy Policy (https://chalc.world/privacy), UK GDPR, Data Protection Act 2018, Online Safety Act 2023, Age Appropriate Design Code, POPIA, GDPR, COPPA, CCPA/CPRA, and other applicable US state privacy laws.

We apply high-privacy default settings and data-minimisation principles for users under 18 in line with the UK Age Appropriate Design Code, COPPA, and other applicable laws.
Liability
The App is provided “as is” without warranties.
CHALC disclaims liability for indirect, incidental, or consequential damages to the fullest extent permitted by law.
Dispute Resolution
Any dispute shall first be resolved through good-faith negotiation.
If unresolved, binding arbitration in Johannesburg, South Africa under AFSA rules (except where prohibited by applicable law).
Class actions are waived where permitted by law. Small claims court available if applicable.
UK and US users retain their rights under UK consumer law and US consumer protection laws (including COPPA and CCPA/CPRA) respectively.
Amendments to Terms
We may update these Terms. Material changes will be notified via in-app notice or email at least 7 days in advance.
Continued use constitutes acceptance.
Governing Law
Governed by the laws of the Republic of South Africa.
For UK users, we fully comply with applicable UK laws including the Online Safety Act 2023, UK GDPR, and the Age Appropriate Design Code where these impose additional obligations.
For US users, we fully comply with applicable US laws including COPPA, CCPA/CPRA, and other state privacy and consumer protection laws where these impose additional obligations.
Jurisdiction: Courts of Johannesburg.
UK and US users may also bring claims in their local courts where UK or US law requires.
