Terms and Conditions

1. Eligibility

  • CHALC Social Limited is open only to users aged 13 years or older.
  • Users aged 13–17 may use the App only after their parent or legal guardian provides verifiable consent.
  • Users under 13 are not permitted to register or use the App.
  • By creating an account, you confirm that you meet these requirements or that a parent or legal guardian has consented, and supervises your use of this App.

2. Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • Notify CHALC Social Limited immediately of any unauthorized use of your account or suspected security breach.
  • CHALC Social Limited will not be liable for loss or damage resulting from your failure to secure your account.

3. Acceptable Use & Community Guidelines

  • All users must follow the CHALC Social Limited Child Safety & Community Guidelines.
  • The following are prohibited: harassment, hate speech, sexual exploitation, discrimination, violence, dangerous challenges, or any harmful or misleading activity.
  • Dangerous challenges include but are not limited to any activity that may cause injury, distress, property damage, or violate law (e.g., stunts, unsafe consumption, or criminal acts).
  • CHALC may suspend, remove, or restrict content or accounts that breach these standards.

4. Challenges & Participation

  • By joining or creating challenges, you agree to follow the challenge rules and act safely and responsibly.
  • You participate in all challenges at your own risk.
  • CHALC Social Limited does not accept liability for injury, damage, or loss arising from participation in challenges.
  • Challenge outcomes are determined as final by the App’s moderation systems.

5. Content Ownership & License

  • You retain ownership of all content you upload.
  • By uploading, you grant CHALC Social Limited a limited, non-exclusive license to host, display, and distribute your content for App functionality and safety purposes.
  • CHALC Social Limited will use user content for marketing only with your explicit consent, or your parent or guardian’s consent if you are under 18.

6. Moderation & Enforcement

  • CHALC Social Limited may restrict, suspend, or permanently ban accounts that violate the Terms or Guidelines.
  • Reports of content, users, or communities are reviewed by CHALC Social Limited moderators.
  • Admin actions may include warnings, temporary suspension, permanent bans, or soft deletion of content.
  • Banned users will receive an in-app and/or email notification, including reasons and appeal instructions via [email protected].
  • Appeals will be reviewed by the CHALC Social Limited moderation team within a reasonable timeframe.

7. Privacy

  • CHALC Social Limited collects and processes personal information in accordance with the Protection of Personal Information Act (POPIA).
  • Guardian consent records are securely stored and retained as required by POPIA.

8. Liability

  • The App is provided “as is”, without warranties of any kind.
  • CHALC Social Limited disclaims liability for direct, indirect, incidental, or consequential damages resulting from use or inability to use the App.

9. Governing Law

  • These terms and conditions are governed by the applicable laws of the Republic of South Africa
